Article R211-8 of the French Code of civil enforcement procedures

A distraining creditor who has not been paid by the garnishee retains his rights against the debtor.
However, if such non-payment is attributable to the negligence of the creditor, the latter loses his rights to the extent of the sums owed by the garnishee.

Le créancier saisissant qui n’a pas été payé par le tiers saisi conserve ses droits contre le débiteur.
Toutefois, si ce défaut de paiement est imputable à la négligence du créancier, celui-ci perd ses droits à concurrence des sommes dues par le tiers saisi.
