Article R212-54 of the French Cinema and Moving Image Code

The application for approval is accompanied by the following information:

1° The general subscription conditions for the package offered to the spectator;

2° The list of cinemas in which the package will be accepted;

3° The commitments made by virtue ofarticle L. 212-28 and, where applicable, the criteria and conditions for implementing the indexation referred to inarticle R. 212-47;

4° The economic data referred to in article L. 212-28, enabling the President of the Centre national du cinéma et du image animée to ensure that the reference price is set in accordance with the criteria provided for in the same article; 5° The standard contract of association setting out the rights and obligations of the subscribers. 212-28, enabling the Chairman of the Centre national du cinéma et de l’image animée to ensure that the reference price is set in accordance with the criteria set out in the same article;

5° The standard association contract setting out the rights and obligations of the exhibitor issuing the package and the associated exhibitors;

6° A copy of the contracts signed with the exhibitors associated with the package, whether or not they benefit from the guaranteed remuneration set out inarticle L. 212-30.

The information mentioned in 5° and 6° is used to assess the fair and non-discriminatory nature of the association conditions offered by the operator issuing the package to operators who benefit from the guaranteed remuneration provided for in article L. 212-30.

Article R212-54

La demande d’agrément est accompagnée des éléments suivants :

1° Les conditions générales d’abonnement de la formule proposée au spectateur ;

2° La liste des établissements de spectacles cinématographiques dans lesquels la formule sera acceptée ;

3° Les engagements pris en vertu del’article L. 212-28 et, le cas échéant, les critères et conditions de mise en œuvre de l’indexation mentionnée àl’article R. 212-47;

4° Les données économiques mentionnées à l’article L. 212-28, permettant au président du Centre national du cinéma et de l’image animée de s’assurer que le prix de référence est fixé selon les critères prévus au même article ;

5° Le contrat type d’association fixant les droits et obligations de l’exploitant émetteur de la formule et des exploitants associés ;

6° Une copie des contrats passés avec les exploitants associés à la formule, qu’ils bénéficient ou non de la rémunération garantie prévue àl’article L. 212-30.

Les éléments mentionnés au 5° et au 6° permettent d’apprécier le caractère équitable et non discriminatoire des conditions d’association proposées par l’exploitant émetteur de la formule aux exploitants qui bénéficient de la rémunération garantie prévue à l’article L. 212-30.
