Article R212-8 of the French Intellectual Property Code

The performer who wishes to exercise the right to terminate the authorisation given to a phonogram producer provided for in article L. 212-3-1 notifies the producer of his intention to terminate by registered letter with acknowledgement of receipt.

The notification specifies:

the surname, first name and address of the performer;

the title, the International Standard Recording Code (ISRC code) or any other means of identifying the phonogram that is not exploited under the conditions provided for in I of article L. 212-3-1.

The cancellation period referred to in II of article L. 212-3-1 runs from the date shown on the postmark.

II.-The performer exercises the right to terminate the authorisation given to a phonogram producer provided for in II of article L. 212-3-1, by notifying the producer of his decision to terminate by registered letter with acknowledgement of receipt.

The notification specifies:

the surname, first name and address of the performer;

the date on which the notification provided for in I was sent.

The termination takes effect the day after the date shown on the postmark.

III.-Where a phonogram contains the fixation of the performances of several performers, the performers shall jointly notify their intention to terminate and their decision to terminate under the conditions provided for in I and II.

L’artiste-interprète qui souhaite exercer le droit de résiliation de l’autorisation donnée à un producteur de phonogrammes prévu à l’article L. 212-3-1 notifie au producteur son intention de résilier par lettre recommandée avec demande d’avis de réception.

La notification précise :

-le nom, le prénom et l’adresse de l’artiste-interprète ;

-le titre, le Code international normalisé des enregistrements (code ISRC) ou tout autre moyen permettant d’identifier le phonogramme qui n’est pas exploité dans les conditions prévues au I de l’article L. 212-3-1.

Le délai de résiliation mentionné au II de l’article L. 212-3-1 court à compter de la date figurant sur le cachet de la poste.

II.-L’artiste-interprète exerce le droit de résiliation de l’autorisation donnée à un producteur de phonogrammes prévu au II de l’article L. 212-3-1, en notifiant au producteur sa décision de résiliation par lettre recommandée avec demande d’avis de réception.

La notification précise :

-le nom, le prénom et l’adresse de l’artiste-interprète ;

-la date d’envoi de la notification prévue au I.

La résiliation prend effet le lendemain de la date figurant sur le cachet de la poste.

III.-Lorsqu’un phonogramme contient la fixation des prestations de plusieurs artistes-interprètes, ceux-ci notifient en commun leur intention de résilier et leur décision de résiliation dans les conditions prévues au I et au II.
