The performer who wishes to exercise the right to terminate the authorisation given to a phonogram producer provided for in article L. 212-3-1 notifies the producer of his intention to terminate by registered letter with acknowledgement of receipt.
The notification specifies:
the surname, first name and address of the performer;
the title, the International Standard Recording Code (ISRC code) or any other means of identifying the phonogram that is not exploited under the conditions provided for in I of article L. 212-3-1.
The cancellation period referred to in II of article L. 212-3-1 runs from the date shown on the postmark.
II.-The performer exercises the right to terminate the authorisation given to a phonogram producer provided for in II of article L. 212-3-1, by notifying the producer of his decision to terminate by registered letter with acknowledgement of receipt.
The notification specifies:
the surname, first name and address of the performer;
the date on which the notification provided for in I was sent.
The termination takes effect the day after the date shown on the postmark.
III.-Where a phonogram contains the fixation of the performances of several performers, the performers shall jointly notify their intention to terminate and their decision to terminate under the conditions provided for in I and II.
