Article R213-3 of the French Cinema and Moving Image Code

The matter may be referred to the mediator for conciliation by the most diligent party, who shall submit to the mediator in writing or orally a request setting out the points at issue in the dispute. The matter may also be referred to the mediator by any interested professional or trade union organisation or by the Chairman of the Centre National du Cinéma et de l’Image Animée, or the mediator may refer the matter to himself.

In the event of a referral on its own initiative or a referral by a professional or trade union organisation or by the Chairman of the Centre national du cinéma et de l’image animée, the mediator shall notify the interested parties of the referral by registered letter with acknowledgement of receipt or by electronic registered letter within the meaning of article R. 53 of the French Post and Electronic Communications Code.

The mediator has fifteen days from the date of referral to attempt to reconcile the parties involved.

Le médiateur peut être saisi pour conciliation par la partie la plus diligente, qui lui adresse par écrit ou lui présente oralement une requête exposant les points sur lesquels porte le litige. Il peut, en outre, être saisi par toute organisation professionnelle ou syndicale intéressée ou par le président du Centre national du cinéma et de l’image animée, ou se saisir d’office.

En cas de saisine d’office ou de saisine par une organisation professionnelle ou syndicale ou par le président du Centre national du cinéma et de l’image animée, le médiateur notifie cette saisine aux parties intéressées par lettre recommandée avec demande d’avis de réception ou par lettre recommandée électronique au sens de l’article R. 53 du code des postes et des communications électroniques.

Le médiateur dispose d’un délai de quinze jours à compter de sa saisine pour tenter de concilier les parties en cause.
