Article R214-13 of the French Intellectual Property Code

When a party invokes business confidentiality, it shall inform the mediator of the information, documents or parts of documents that it considers, at the time of their communication, to be covered by such confidentiality and which may not therefore be made public.

The mediator may only bring such information or documents or parts of documents covered by business confidentiality to the attention of the other party or parties with the agreement of the party invoking such confidentiality.
The mediator may only bring to the attention of the other party or parties such information, documents or parts of documents covered by business secrecy with the agreement of the party invoking such secrecy.

Lorsqu’une partie se prévaut du secret des affaires, elle signale au médiateur les informations, documents ou partie de documents qu’elle estime, à l’occasion de leur communication, couverts par ce secret et qui ne peuvent alors être rendus publics.


Le médiateur ne peut porter à la connaissance de la ou des autres parties ces informations ou documents ou partie de documents couverts par le secret des affaires qu’avec l’accord de la partie qui s’en prévaut.
