Article R214-168 of the French Monetary and Financial Code

The work and felling carried out in the woods and forests held by forest savings companies must comply with the following conditions:

1° Subject to the provisions of Article R. 214-166, the work and felling must be carried out in accordance with an approved simple management plan;

2° Any felling not provided for in the simple management plan must be subject to prior authorisation from the Centre National de la Propriété Forestière in application of articles R. 312-12 to R. 312-17 of the Code Forestier. The resulting compulsory restocking work is the subject of an amendment to the simple management plan in accordance with article R. 312-10 of the same code. In addition, if this work involves an amount greater than 10% of the last market value of the forest in question, it is subject to special authorisation by the ordinary general meeting of members.

Les travaux et coupes de bois auxquels il est procédé dans les bois et forêts détenus par les sociétés d’épargne forestière respectent les conditions suivantes :

1° Sous réserve des dispositions prévues à l’article R. 214-166, les travaux et coupes de bois doivent être réalisés conformément à un plan simple de gestion agréé ;

2° Les coupes non prévues au plan simple de gestion font l’objet d’une autorisation préalable du Centre national de la propriété forestière en application des articles R. 312-12 à R. 312-17 du code forestier. Les travaux de reconstitution obligatoire qui en découlent font l’objet d’un avenant au plan simple de gestion conformément à l’article R. 312-10 du même code. En outre, si ces travaux portent sur un montant supérieur à 10 % de la dernière valeur vénale de la forêt considérée, ils font l’objet d’une autorisation spéciale de l’assemblée générale ordinaire des associés.
