Article R2141-1-2 of the French Public Health Code

The Minister for Health shall register a procedure on the list mentioned in Article L. 2141-1, on his own initiative or at the request of an establishment, laboratory, health cooperation group or body mentioned in Article R. 2141-1-6, after consulting the Agence de la biomédecine. The latter must give its opinion within four months, accompanied by the reasoned opinion of its Steering Committee and the technical file mentioned in Article R. 2141-1-3. This period may be extended to six months if the Agency considers it necessary.

Le ministre chargé de la santé procède à l’inscription d’un procédé sur la liste mentionnée par l’article L. 2141-1, à son initiative ou sur demande d’un établissement, d’un laboratoire, d’un groupement de coopération sanitaireou d’un organisme mentionnés à l’article R. 2141-1-6, après avoir consulté l’Agence de la biomédecine. Celle-ci rend son avis dans un délai de quatre mois, accompagné de l’avis motivé de son conseil d’orientation et du dossier technique mentionné à l’article R. 2141-1-3. Ce délai est porté à six mois si l’agence l’estime nécessaire.
