Article R2141-1-6 of the French Public Health Code

The application for authorisation of a technique modifying a process included on the list mentioned in article L. 2141-1 may be submitted by any health establishment, medical biology laboratory, health cooperation group or organisation authorised to carry out medically assisted procreation activities in application of article L. 2142-1.

The applicant attaches to its application a file containing all the information required to assess the technique, the model for which is set by decision of the Director General of the Agence de la biomédecine.

The Director General of the Agence de la biomédecine may request, by registered letter with acknowledgement of receipt, any additional information that he considers necessary for the assessment of the application. He will indicate to the applicant the deadline by which this information must be provided. This request for additional information suspends the deadline mentioned in Article R. 2141-1-8.

Article R2141-1-6

La demande d’autorisation d’une technique modifiant un procédé figurant sur la liste mentionnée à l’article L. 2141-1 peut être présentée par tout établissement de santé, laboratoire de biologie médicale, groupements de coopération sanitaire ou organisme autorisé à exercer des activités d’assistance médicale à la procréation en application de l’article L. 2142-1.

Le demandeur joint à sa demande un dossier qui comprend tous les éléments nécessaires à l’évaluation de la technique et dont le modèle est fixé par décision du directeur général de l’Agence de la biomédecine.

Le directeur général de l’Agence de la biomédecine peut demander, par lettre recommandée avec demande d’avis de réception, toute information complémentaire qu’il estime nécessaire à l’instruction du dossier. Il indique au demandeur le délai dans lequel ces informations doivent être fournies. Cette demande d’information complémentaire suspend le délai mentionné à l’article R. 2141-1-8.
