Article R2141-1-7 of the French Public Health Code

When authorisation is sought for a technique that modifies a procedure on the list mentioned in Article L. 2141-1 , the Director General of the Agence de la biomédecine refers the matter to the Agency’s Orientation Board. The latter gives a reasoned opinion on the nature and interest of the proposed modification and assesses in particular, in the light of the technical dossier for the process for which the modification is envisaged and the information provided by the applicant, whether it is an improvement to an existing process or a new process. In particular, any modification which introduces an additional critical step or additional manipulation of gametes, germinal tissue or embryos compared with the existing process constitutes a new process.

Lorsque l’autorisation d’une technique modifiant un procédé figurant sur la liste mentionnée à l’article L. 2141-1 est demandée, le directeur général de l’Agence de la biomédecine saisit le conseil d’orientation de cette agence. Celui-ci se prononce, par un avis motivé, sur la nature et sur l’intérêt de la modification proposée et apprécie en particulier, au vu du dossier technique du procédé dont la modification est envisagée et des éléments fournis par le demandeur, s’il s’agit de l’amélioration d’un procédé existant ou d’un nouveau procédé. Constitue notamment un nouveau procédé toute modification introduisant, par rapport au procédé existant, une étape critique supplémentaire ou une manipulation supplémentaire des gamètes, tissus germinaux ou embryons.
