Article R2141-1-9 of the French Public Health Code

The Director General of the Agence de la biomédecine may at any time suspend or withdraw authorisation for the implementation of a technique if the conditions laid down in this section are no longer satisfied or for any public health reason. Suspension for a period of more than three months and withdrawal are decided after obtaining the opinion of the Agency’s Steering Committee. Reasons must be given for the decision and the conditions for its application to current medically assisted procreation activities must be specified. The Agence de la biomédecine immediately informs the laboratories, health cooperation groups and organisations that use this technique of the suspension or withdrawal of its authorisation, in particular with a view to the implementation, where applicable, of the provisions of the first paragraph of Article L. 1111-2.

Le directeur général de l’Agence de la biomédecine peut à tout moment suspendre ou retirer l’autorisation de mise en œuvre d’une technique si les conditions posées à la présente section ne sont plus satisfaites ou pour tout motif de santé publique. La suspension pour une durée supérieure à trois mois et le retrait sont décidés après avis du conseil d’orientation de l’agence. La décision est motivée et précise les conditions de son application aux activités d’assistance médicale à la procréation en cours. L’Agence de la biomédecine informe sans délai les laboratoires, groupements de coopération sanitaire et organismes qui utilisent cette technique de la suspension ou du retrait de son autorisation, en vue notamment de la mise en œuvre, s’il y a lieu, des dispositions du premier alinéa de l’article L. 1111-2.
