Article R2141-7 of the French Public Health Code

The centre referred to in the first paragraph of article R. 2141-3 shall compile a file containing information on the two members of the couple or the unmarried woman at the origin of conception which may be brought to the attention of a doctor, at his request, in the event of medical necessity pursuant to the fourth paragraph of article L. 2141-6.

This information relates in particular, in pseudonymised form, to :

1° The personal and family medical history of each member of the couple or of the unmarried woman and current clinical data deemed necessary by the practitioners ;

2° The results of the compulsory health screening tests provided for in article R. 2141-4 . The practitioner mentioned in article R. 2141-4 is responsible for keeping the file and ensuring the accuracy of the information recorded therein.

3° All information relating to the progress of pregnancies resulting from embryo reception, including any interruption, the date of birth and the state of health of newborns and children.

The pseudonymisation of the file and the allocation of the unique European code are carried out by the centre mentioned in article R. 2142-7.

The file must be archived under conditions that guarantee the confidentiality of the information it contains.

Article R2141-7

Le centre mentionné au premier alinéa de l’article R. 2141-3 constitue un dossier contenant les informations sur les deux membres du couple ou la femme non mariée à l’origine de la conception qui peuvent être portées à la connaissance d’un médecin, sur sa demande, en cas de nécessité médicale en application du quatrième alinéa de l’article L. 2141-6.

Ces informations portent notamment, sous forme pseudonymisée, sur :

1° Les antécédents médicaux personnels et familiaux de chacun des membres du couple ou de la femme non mariée et les données cliniques actuelles jugées nécessaires par les praticiens ;

2° Les résultats des tests de dépistages sanitaires obligatoires prévus à l’article R. 2141-4. Le praticien mentionné à l’article R. 2141-4 est responsable de la tenue du dossier et de l’exactitude des informations qui y sont consignées.

3° Toute information relative à l’évolution des grossesses résultant d’un accueil d’embryon, y compris leur éventuelle interruption, la date de naissance et l’état de santé des nouveau-nés et des enfants.

La pseudonymisation du dossier ainsi que l’attribution du code européen unique sont réalisées par le centre mentionné à l’article R. 2142-7.

L’archivage de ce dossier doit être effectué dans des conditions garantissant la confidentialité des informations qu’il contient.
