Article R2141-9 of the French Public Health Code

Without prejudice to the application of the provisions of article L. 2141-10, any embryo reception must be preceded by at least one interview between the couple or unmarried woman wishing to receive an embryo and the centre’s multidisciplinary clinico-biological medical team, in particular the doctor qualified in psychiatry or the psychologist. This centre is authorised to store embryos with a view to their reception and to carry out this reception.

A practitioner from this centre, who meets the criteria mentioned in article R. 2142-10 for carrying out the clinical activities for implementing embryo reception mentioned in e of 1° of article R. 2142-1, draws up a document certifying that the couple or unmarried woman wishing to receive an embryo:

-has been informed of the legislative and regulatory provisions relating to medically assisted procreation and of the constraints and risks in the current state of knowledge ;

-meets the conditions laid down in Articles L. 2141-2 and L. 2141-6 ;

-does not present any medical contraindication to the reception of an embryo.

Article R2141-9

Sans préjudice de l’application des dispositions de l’article L. 2141-10, tout accueil d’embryon doit être précédé d’au moins un entretien du couple ou de la femme non mariée désireux d’accueillir un embryon avec l’équipe médicale clinico-biologique pluridisciplinaire du centre, en particulier avec le médecin qualifié en psychiatrie ou le psychologue. Ce centre est autorisé à conserver les embryons en vue de leur accueil et à mettre en œuvre celui-ci.

Un praticien de ce centre, répondant aux critères mentionnés à l’article R. 2142-10 pour l’exercice des activités cliniques de mise en œuvre de l’accueil d’embryon mentionnées au e du 1° de l’article R. 2142-1, établit un document certifiant que le couple ou la femme non mariée souhaitant accueillir un embryon :

-a été informé des dispositions législatives et réglementaires en matière d’assistance médicale à la procréation ainsi que des contraintes et risques en l’état des connaissances ;

-répond aux conditions prévues aux articles L. 2141-2 et L. 2141-6 ;

-ne présente pas de contre-indication médicale à l’accueil d’un embryon.
