Article R2142-6 of the French Public Health Code

The clinical and biological authorisations for medically assisted procreation referred to in the last paragraph of Article L. 2142-1 are combined when the authorisation to carry out the biological activities referred to in b of 2° of Article R. 2142-1 and the authorisation to carry out the clinical activities referred to in a and c and possibly d of 1° of Article R. 2142-1 have been issued respectively:

-either to the same health establishment ;

-two health establishments linked by agreement; or

-or to a health establishment and a medical biology analysis laboratory or organisation linked by agreement.

Obtaining authorisation to carry out the clinical activities mentioned in the first paragraph is subject to obtaining authorisation to carry out biological activities, and vice versa.

The agreement referred to in this article must be produced at the time of the compliance visit provided for in article L. 6122-4.

Article R2142-6

La réunion des autorisations clinique et biologique d’assistance médicale à la procréation mentionnée au dernier alinéa de l’article L. 2142-1 est réalisée lorsque l’autorisation de pratiquer les activités biologiques mentionnées au b du 2° de l’article R. 2142-1 et l’autorisation de pratiquer les activités cliniques mentionnées au a et au c et éventuellement au d du 1° de l’article R. 2142-1 ont été respectivement délivrées :

-soit à un même établissement de santé ;

-soit à deux établissements de santé liés par convention ;

-soit à un établissement de santé et à un laboratoire d’analyses de biologie médicale ou organisme liés par convention.

L’obtention de l’autorisation de pratiquer les activités cliniques mentionnées au premier alinéa est subordonnée à l’obtention de l’autorisation de pratiquer les activités biologiques et inversement.

La convention mentionnée au présent article doit être produite au moment de la visite de conformité prévue à l’article L. 6122-4.
