Article R2143-1 of the French Public Health Code

For the application of this chapter:

1° Where the embryo or embryos referred to in the first paragraph of Article L. 2143-1 have been conceived as a result of a sperm donation, an oocyte donation or a sperm donation and an oocyte donation, the notion of third party donor refers to the person or persons having consented to these gamete donations as well as the couple, the surviving member or the unmarried woman having consented to the reception of her embryos in application of Article L. 2141-5;

2° The notion of use of the donation is understood to mean the allocation of gametes or embryos to the beneficiaries of medically assisted procreation with a third party donor;

3° The data relating to the identity of the third party donor mentioned in Article L. 2143-3 is the birth name, first names, sex, date and place of birth;

4° The non-identifying data of the third party donor referred to in the same article refers to data distinct from that relating to his identity and which does not enable him or a third party to be directly identified.

Pour l’application du présent chapitre :


1° Lorsque le ou les embryons mentionnés au premier alinéa de l’article L. 2143-1 ont été conçus grâce à un don de sperme, un don d’ovocyte ou un don de sperme et un don d’ovocyte, la notion de tiers donneur s’entend de la ou des personnes ayant consenti à ces dons de gamètes ainsi que du couple, du membre survivant ou de la femme non mariée ayant consenti à l’accueil de ses embryons en application de l’article L. 2141-5 ;


2° La notion d’utilisation du don s’entend de l’attribution des gamètes ou des embryons aux bénéficiaires de l’assistance médicale à la procréation avec tiers donneur ;


3° Les données relatives à l’identité du tiers donneur mentionnées à l’article L. 2143-3 sont le nom de naissance, les prénoms, le sexe, la date et le lieu de naissance ;


4° Les données non identifiantes du tiers donneur mentionnées au même article désignent les données distinctes de celles relatives à son identité et ne permettant pas son identification directe ou celle d’un tiers.
