I.-Third-party donors who are not subject to the provisions of Chapter III of Title IV of Book I of Part Two of the Legislative Part of this Code at the time of donation may, at any time, contact the Commission d’accès des personnes nées d’une assistance médicale à la procréation aux données des tiers donneurs, in order to give their consent for their identity and non-identifying data mentioned in Article L. 2143-3 to be communicated to the Commission.
They may also express this consent to the commission when it contacts them after having received a request for access to their identity or non-identifying data in application of D of VIII ofarticle 5 of law no. 2021-1017 of 2 August 2021 relating to bioethics.
II – On this occasion, the third party donor is informed that his consent applies to all requests for access made by adults conceived from his gametes or embryos and that it cannot be revoked.
III – The consent of the person concerned is obtained by the Committee in accordance with the model provided for in the first paragraph of article R. 2143-4.
IV -After obtaining their consent, third party donors communicate, within a period of three months, the identity data and non-identifying data mentioned in I of article L. 2143-3 to a health organisation or establishment mentioned in the third paragraph of article L. 2142-1, under the conditions set out in article R. 2143-5.
As soon as it is received, the data communicated by the third party donors is included in the data processing provided for in article L. 2143-4 and supplemented by the information mentioned in II of article L. 2143-3, when it is found that the gametes or embryos donated have been used.
