Article R2151-3 of the French Public Health Code

Only the following may obtain authorisation to carry out embryo research:

1° Public health establishments and medical biology laboratories authorised to store embryos pursuant to Article L. 2142-1, and establishments authorised to carry out pre-implantation diagnosis pursuant to Article L. 2131-4 ;

2° Establishments and organisations that have signed an agreement with at least one of the establishments or laboratories mentioned in 1°. This agreement sets out the conditions under which the establishment or laboratory mentioned in 1° stores and makes embryos available to this establishment or organisation. Embryos may only be made available for the duration of the research.

Seuls peuvent obtenir l’autorisation de procéder à une recherche sur l’embryon :

1° Les établissements publics de santé et les laboratoires de biologie médicale autorisés à conserver des embryons en application de l’article L. 2142-1, ainsi que les établissements autorisés à pratiquer le diagnostic préimplantatoire en application de l’article L. 2131-4 ;

2° Les établissements et organismes ayant conclu une convention avec l’un au moins des établissements ou laboratoires mentionnés au 1°. Cette convention prévoit les conditions dans lesquelles l’établissement ou le laboratoire mentionné au 1° conserve et met à disposition des embryons au bénéfice de cet établissement ou organisme. La mise à disposition d’embryons n’est autorisée que pour la seule durée de la recherche.
