Article R2151-7 of the French Public Health Code

Any decision by the Director General to authorise or refuse research and the opinion of the Steering Committee are forwarded simultaneously to the Ministers for Health and Research, who have a period of one month in which to jointly request a re-examination of the application for authorisation, in application of 1° and 2° of III of article L. 2151-5.

When a request for re-examination of an authorised protocol is made by the Ministers, the Director General suspends the authorisation granted for a period of two months. The suspension decision is notified to the authorisation holder.

At the end of the thirty-day period during which the Agency re-examines the application, the silence of the administration is deemed to be confirmation of the initial decision of the Director General of the Agency.

Toute décision du directeur général d’autorisation ou de refus de recherche et l’avis du conseil d’orientation sont transmis simultanément aux ministres chargés de la santé et de la recherche, qui disposent d’un délai d’un mois pour demander conjointement un nouvel examen du dossier de demande d’autorisation, en application des 1° et 2° du III de l’article L. 2151-5.

Lorsqu’une demande de réexamen d’un protocole autorisé est formulée par les ministres, le directeur général suspend l’autorisation délivrée pour une durée de deux mois. La décision de suspension est notifiée au titulaire de l’autorisation.

A l’issue de la période de trente jours durant laquelle l’agence procède au nouvel examen de la demande, le silence de l’administration vaut confirmation de la décision initiale du directeur général de l’agence.
