Article R221-39 of the French Code of civil enforcement procedures

A deed of sale is drawn up. This deed shall contain a description of the goods sold, the amount of the hammer price and a statement of the full names of the successful bidders. An extract of the entries in the register referred to in article R. 521-1 of the French Commercial Code, drawn up in application of article R.221-14-1, is attached to the deed.

Upon proof of payment of the price, the registrations of securities taken out on the property sold on behalf of the distrainee debtor shall be cancelled.

Il est dressé acte de la vente. Cet acte contient la désignation des biens vendus, le montant de l’adjudication et l’énonciation déclarée des nom et prénoms des adjudicataires. Il y est annexé un extrait des inscriptions au registre mentionné à l’article R. 521-1 du code de commerce levé en application de l’article R.221-14-1.

Il est procédé, sur justification du paiement du prix, à la radiation des inscriptions de sûretés prises sur les biens vendus du chef du débiteur saisi.
