Article R222-8 of the French Code of civil enforcement procedures

If no voluntary surrender is made within the time limit set, the distraining creditor may apply to the enforcement judge in the place where the third party holder of the property resides for an order to surrender the property. The execution judge may also be seised by the third party.
The summons provided for in article R. 222-7 and any precautionary measures that may have been taken shall lapse if the enforcement judge is not seised within one month of the day on which the summons was served.

A défaut de remise volontaire dans le délai imparti, le créancier saisissant peut demander au juge de l’exécution du lieu où demeure le tiers détenteur du bien d’ordonner la remise de celui-ci. Le juge de l’exécution peut également être saisi par le tiers.
La sommation prévue à l’article R. 222-7 et les mesures conservatoires qui auraient pu être prises deviennent caduques si le juge de l’exécution n’est pas saisi dans le mois qui suit le jour où la sommation a été signifiée.
