Article R223-11 of the French Commercial code

Notification of the proposed transfer or pledge of company shares, provided for in the second paragraph of Article L. 223-14 and Article L. 223-15, shall be made by extrajudicial document or by registered letter with acknowledgement of receipt.

The appointment of the expert provided for in Article 1843-4 of the Civil Code shall be made by the President of the Commercial Court ruling under the accelerated procedure on the merits. The president of the commercial court shall rule by order on request to extend the time limit provided for in the third paragraph of article L. 223-14 and by summary order in the case provided for in the fourth paragraph of the same article. These decisions are not subject to appeal.

La notification du projet de cession ou de nantissement de parts sociales, prévue au deuxième alinéa de l’article L. 223-14 et à l’article L. 223-15, est faite par acte extrajudiciaire ou par lettre recommandée avec demande d’avis de réception.

La désignation de l’expert prévue à l’article 1843-4 du code civil est faite par le président du tribunal de commerce statuant selon la procédure accélérée au fond. Il statue par ordonnance sur requête pour prolonger le délai prévu au troisième alinéa de l’article L. 223-14 et par ordonnance de référé dans le cas prévu au quatrième alinéa du même article. Ces décisions ne sont pas susceptibles de recours.
