Article R23-112-19 of the French Labour Code

If it is not possible to appoint a representative within the time limit set by the order referred to in Article R. 23-112-10 or if a member of the Commission ceases to hold office, another member may be appointed to the Commission under the conditions set out in this sub-section. However, this appointment shall not be made less than six months before the end of the term of office.

Members appointed in accordance with the previous paragraph are appointed for the remainder of their term of office.

En cas d’impossibilité de désigner un représentant dans les délais fixés par l’arrêté mentionné à l’article R. 23-112-10 ou de cessation des fonctions d’un membre de la commission, il peut être procédé à la désignation d’un autre membre pour cette commission dans les conditions définies à la présente sous-section. Toutefois, il n’est pas procédé à cette désignation moins de six mois avant la fin du mandat.

Les membres désignés en application de l’alinéa précédent le sont pour la durée du mandat restant à courir.
