Article R23-2 of the French Code of Criminal Procedure

The Public Prosecutor’s Office, of its own motion or at the request of the civil parties, shall produce to the departments of the Directorate General of Public Finances, which are responsible for the recovery of the portion of the bond forfeited to the State in the case provided for in Article 142-2 (paragraph 2), a certificate from the court registry drawn up in duplicate stating the liability incurred by the person under investigation in this case and, where applicable, a second certificate stating the convictions handed down and the number of the extract from the judgment or decree in the cases provided for by Articles 142-3 (paragraph 2) and 372.

The Caisse des dépôts et consignations shall distribute the sums deposited to the entitled parties without delay.

Any dispute relating to the application of this article shall be judged on application, in chambers, as an incident to the enforcement of the judgment or decree.

Article R23-2

Le ministère public, d’office ou à la demande des parties civiles, produit aux services de la direction générale des finances publiques qui assurent au titre des produits divers du budget le recouvrement de la fraction du cautionnement acquise à l’Etat dans le cas prévu par l’article 142-2 (alinéa 2), un certificat du greffe établi en double exemplaire constatant la responsabilité encourue par la personne mise en examen dans ce cas et, éventuellement, un second certificat mentionnant les condamnations prononcées et le numéro de l’extrait du jugement ou d’arrêt dans les cas prévus par les articles 142-3 (alinéa 2) et 372.

La Caisse des dépôts et consignations distribue sans délai, aux ayants droit, les sommes déposées.

Toute contestation relative à l’application du présent article est jugée sur requête, en chambre du conseil, comme incident de l’exécution du jugement ou de l’arrêt.
