In the collective childcare establishments referred to in 1° and 2° of II of article R. 2324-17, the maximum number of children cared for simultaneously may reach 115% of the childcare capacity provided for in the authorisation from the Chairman of the Departmental Council or in the request for an opinion sent to him, subject to compliance with the following conditions:
1° The weekly occupancy rate of the establishment does not exceed 100% of the weekly hourly childcare capacity calculated according to the number of hours the establishment is open per week. The methods for calculating the weekly occupancy rate are specified by order of the Minister responsible for the family;
2° The staffing rules set out in article R. 2324-43 are complied with with regard to the total number of children actually being cared for at any one time;
3° At the request of the departmental maternal and child protection service, the manager of the establishment provides the information required to monitor compliance with the provisions of this article in accordance with the methods set out by order of the Minister responsible for the family;
4° The operating regulations set out the procedures for organising excess childcare in the establishment and how it relates to the educational and social projects mentioned in 1° and 2° of article R. 2324-29.
