Article R2324-34-2 of the French Public Health Code

Subject to authorisation from the President of the Departmental Council in the case of establishments and services managed by private individuals, or his opinion in the case of establishments and services managed by a public authority, issued under the conditions set out in articles R. 2324-19 and R. 2324-21, and subject to compliance with the provisions of 2° of article R. 2324-30, up to three establishments and services, each with a capacity of twenty-four places or less, may be managed by the same person when the total capacity of the said establishments and services does not exceed fifty-nine places.

In giving its authorisation or formulating its opinion, the President of the Departmental Council takes into account any recruitment difficulties, the capacity of the establishments and services concerned, their opening hours, the distance between them and the skills of the other professionals employed there.

The overall capacity of the establishments and services placed under the management of one person is taken into account when applying the provisions of articles R. 2324-34, R. 2324-46-1, R. 2324-47-1 and R. 2324-48-1.

Sous réserve de l’autorisation du président du conseil départemental pour les établissements et services gérés par des personnes de droit privé, ou de son avis pour les établissements et services gérés par une collectivité publique, délivrés dans les conditions prévues aux articles R. 2324-19 et R. 2324-21, et du respect des dispositions du 2° de l’article R. 2324-30, la direction de plusieurs établissements et services, dans la limite de trois, chacun d’une capacité inférieure ou égale à vingt-quatre places, peut être assurée par une même personne lorsque la capacité totale desdits établissements et services n’excède pas cinquante-neuf places.

Le président du conseil départemental prend en compte, pour donner son autorisation ou formuler son avis, les difficultés éventuelles de recrutement, la capacité des établissements et services concernés, leur amplitude d’ouverture, la distance qui les sépare, ainsi que les compétences des autres professionnels qui y sont employés.

Il est tenu compte de la capacité globale des établissements et services placés sous la direction d’une personne pour l’application des dispositions des article R. 2324-34, R. 2324-46-1, R. 2324-47-1 et R. 2324-48-1.
