I.-Any collective childcare establishment mentioned in 1° or 2° of II of article R. 2324-17 must ensure that the number of professionals mentioned in article R. 2324-42 working in the establishment with the children actually cared for complies with the requirements laid down in articles R. 2324-46-4 and R. 2324-47-4 respectively. The minimum number of staff in the establishment responsible for supervising the children, resulting from the application to the number of children actually cared for of the staffing ratios mentioned in articles R. 2324-46-4 and R. 2324-47-4, must be respected at all times.
The establishment’s monthly reference number of staff is defined, for a calendar month, as the average value, over that month, of the minimum number of staff responsible for supervising children mentioned in the previous paragraph. The methods of calculation are specified by an order of the Minister responsible for the family.
II – Children and their accompanying childminders who are occasionally present in a collective childcare establishment, in particular as part of a multi-accueil structure, are not counted in the number of children and staff used to calculate the staffing levels provided for in I of this article.
