Article R2331-2 of the French Labour Code

The social and economic committee or the representative trade union organisations of the dominant undertaking or of an undertaking in the group may refer to the judicial court at the registered office of the dominant undertaking disputes relating to:
1° the constitution and composition of the group works council;
2° inclusion in the group works council.

Le comité social et économique ou les organisations syndicales représentatives de l’entreprise dominante ou d’une entreprise du groupe peuvent saisir le tribunal judiciaire du siège de l’entreprise dominante pour les litiges relatifs :
1° A la constitution et à la composition du comité de groupe ;
2° A l’inclusion dans le comité de groupe.
