Article R237-12 of the French Commercial code

In the case provided for in article L. 237-19, the liquidator is appointed by order of the president of the commercial court, ruling on a petition.

Any interested party may lodge an objection to the order within fifteen days of its publication under the conditions set out in article R. 237-2. This objection is brought before the Commercial Court, which may appoint another liquidator.

Dans le cas prévu à l’article L. 237-19, le liquidateur est désigné par ordonnance du président du tribunal de commerce, statuant sur requête.

Tout intéressé peut former opposition à l’ordonnance dans le délai de quinze jours à dater de sa publication dans les conditions prévues à l’article R. 237-2. Cette opposition est portée devant le tribunal de commerce qui peut désigner un autre liquidateur.
