Article R2373-3 of the French Labour Code

Disputes relating to the appointment of employee representatives and the election of works council members of the company resulting from the cross-border operation whose registered office is located in France, as well as to the appointment of employee representatives of participating companies, establishments or subsidiaries located in France, fall within the jurisdiction of the judicial court of the registered office of the company resulting from the cross-border operation, of the participating company, of the subsidiary or of the establishment concerned.

These disputes are lodged, investigated and judged in accordance with the procedures set out in articles R. 2324-24 and R. 2324-25.

The appeal must be lodged within fifteen days of notification of the appointment to the employer.

Les contestations relatives à la désignation des représentants des salariés et à l’élection des membres du comité de la société issue de l’opération transfrontalière dont le siège se situe en France, ainsi qu’à la désignation des représentants des salariés des sociétés participantes, des établissements ou filiales implantés en France, sont de la compétence du tribunal judiciaire du siège de la société issue de l’opération transfrontalière, de la société participante, de la filiale ou de l’établissement concerné.


Ces contestations sont formées, instruites et jugées selon les modalités prévues aux articles R. 2324-24 et R. 2324-25.


Le recours est formé dans un délai de quinze jours à compter de la notification de la désignation à l’employeur.
