Article R2373-5 of the French Labour Code

The information provided, pursuant to the fourth paragraph of Article L. 229-3 of the French Commercial Code, by the directors of the company, subsidiary or establishment concerned by the transaction to certify that the terms and conditions relating to employee participation have been set in accordance with the provisions of Articles L. 2371-1 to L. 2371-3, L. 2372-1 to L. 2372-4, the second paragraph of Article L. 2372-5 and Articles L. 2372-6 to L. 2374-2 shall be sent to the Labour Inspectorate.

Les éléments fournis, en application du quatrième alinéa de l’article L. 229-3 du code de commerce, par les dirigeants de la société, la filiale ou l’établissement concernés par l’opération pour attester que les modalités relatives à la participation des salariés ont été fixées conformément aux dispositions des articles L. 2371-1 à L. 2371-3, L. 2372-1 à L. 2372-4, du second alinéa de l’article L. 2372-5 et des articles L. 2372-6 à L. 2374-2 sont transmis à l’agent de contrôle de l’inspection du travail.
