Article R24-6 of the French Code of Criminal Procedure

Where a security interest has been granted, the judicial supervision order specifies that the person under investigation and, depending on the case, the provisional beneficiary, the Treasury or the civil party or parties involved in establishing the security interest must inform the examining magistrate of the disposal of the encumbered asset or the payment of compensation resulting from its destruction. If the investigation is completed, the information is communicated to the public prosecutor.

The order also states that the sums of money received on these occasions will be subject to a bond in accordance with the procedures set out in article R. 24-7.

Article R24-6

Lorsqu’une sûreté réelle est retenue, l’ordonnance de placement sous contrôle judiciaire précise que la personne mise en examen ainsi que, selon les cas, le bénéficiaire provisoire, le Trésor public ou la ou les parties civiles qui sont parties à la constitution de la sûreté sont tenues d’informer le juge d’instruction de l’aliénation du bien grevé ou du versement d’une indemnité résultant de sa destruction. Si l’instruction est terminée, l’information est communiquée au procureur de la République.

L’ordonnance indique, en outre, que les sommes d’argent perçues à ces occasions feront l’objet d’un cautionnement selon les modalités prévues à l’article R. 24-7.
