Article R2421-1 of the French Labour Code

The request for authorisation to dismiss a trade union delegate, a mandated employee, a member of the staff delegation to the inter-company social and economic committee or an employee adviser is sent to the labour inspector responsible for the establishment under the conditions defined in article L. 2421-3.

Where the trade union delegate also benefits from the protection provided for in sections 3 and 4 of chapter I of title I of the legislative part, the request is accompanied by the minutes of the meeting of the social and economic committee.

In this case, except in the case of a lay-off, the request is sent within fifteen days of the date on which the opinion of the social and economic committee was issued.

In all cases, the request must state the reasons for the proposed dismissal. It is sent electronically in accordance with the procedures set out in articles R. 112-9 to R. 112-9-2 of the Code of relations between the public and the administration or by registered letter with acknowledgement of receipt in duplicate.

Article R2421-1

La demande d’autorisation de licenciement d’un délégué syndical, d’un salarié mandaté, d’un membre de la délégation du personnel au comité social et économique interentreprises ou d’un conseiller du salarié est adressée à l’inspecteur du travail dont dépend l’établissement dans les conditions définies à l’article L. 2421-3.

Lorsque le délégué syndical bénéficie également de la protection prévue aux sections 3 et 4 du chapitre Ier du titre Ier de la partie législative, la demande est accompagnée du procès-verbal de la réunion du comité social et économique.

Dans ce cas, sauf dans l’hypothèse d’une mise à pied, la demande est transmise dans les quinze jours suivant la date à laquelle a été émis l’avis du comité social et économique.

Dans tous les cas, la demande énonce les motifs du licenciement envisagé. Elle est transmise par voie électronique selon les modalités prévues aux articles R. 112-9 à R. 112-9-2 du code des relations entre le public et l’administration ou par lettre recommandée avec avis de réception en deux exemplaires.
