Article R249-8 of the French Code of Criminal Procedure

After the compensation has been authorised, an appeal against the decision may be lodged with the court mentioned in a or b of article R. 249-6 by the public prosecutor at the request of the assigning accountant, within one month of receipt of the request for payment.

A reasoned refusal by the Public Prosecutor to exercise the appeal shall be brought to the attention of the assigning accounting officer. In this case, the latter shall execute the decision.

Après l’ordonnancement de l’indemnité, un recours contre la décision peut être formé devant la juridiction mentionnée au a ou au b de l’article R. 249-6 par le ministère public à la demande du comptable assignataire, dans le délai d’un mois à compter de la réception de la demande de paiement.

Le refus motivé du ministère public d’exercer le recours est porté à la connaissance du comptable assignataire. Dans ce cas, celui-ci exécute la décision.
