Article R2523-8 of the French Labour Code

In the case of a dispute with a national impact or whose impact extends to more than one region, where the parties are unable to agree on the choice of a mediator within three days of the submission of the request or where the mediation procedure is initiated by the Minister responsible for labour, the latter, after having taken cognisance of the proposals made by the parties, appoints the mediator from among the persons appearing on the list provided for in Article.

Dans le cas d’un conflit à incidence nationale ou dont l’incidence s’étend à plus d’une région lorsque les parties ne peuvent se mettre d’accord sur le choix d’un médiateur dans un délai de trois jours suivant le dépôt de la requête ou lorsque la procédure de médiation est engagée par le ministre chargé du travail, celui-ci, après avoir pris connaissance des propositions faites par les parties, désigne le médiateur parmi les personnes figurant sur la liste prévue à l’article.
