Article R26 of the French Code of Criminal Procedure

The matter shall be referred to the First President of the Court of Appeal within whose jurisdiction the decision to dismiss the case, acquit or acquit was handed down by a request signed by the applicant or one of the agents mentioned in the first paragraph of Article R. 27 and delivered against a receipt or sent by registered letter with acknowledgement of receipt to the registry of the court of appeal.

The application shall contain a statement of the facts, the amount of compensation sought and any useful information, in particular with regard to:

1° The date and nature of the decision ordering pre-trial detention and the prison where such detention was served;

2° The court that handed down the decision to dismiss, acquit or acquit and the date of that decision;

3° The address where notifications are to be made to the applicant.

The application shall be accompanied by any supporting documents, in particular a copy of the decision to dismiss, discharge or acquit.

The six-month period provided for in article 149-2 does not run from the date of the decision to dismiss, discharge or acquit that has become final unless, at the time of notification of this decision, the person was informed of their right to claim compensation and of the provisions of Article 149-1,149-2 and 149-3 (first paragraph).

Article R26

Le premier président de la cour d’appel dans le ressort de laquelle a été prononcée la décision de non-lieu, de relaxe ou d’acquittement est saisi par une requête signée du demandeur ou d’un des mandataires mentionnés au premier alinéa de l’article R. 27 et remise contre récépissé ou adressée par lettre recommandée avec demande d’avis de réception au greffe de la cour d’appel.

La requête contient l’exposé des faits, le montant de la réparation demandée et toutes indications utiles, notamment en ce qui concerne :

1° La date et la nature de la décision qui a ordonné la détention provisoire ainsi que l’établissement pénitentiaire où cette détention a été subie ;

2° La juridiction qui a prononcé la décision de non-lieu, de relaxe ou d’acquittement ainsi que la date de cette décision ;

3° L’adresse où doivent être faites les notifications au demandeur.

La requête est accompagnée de toutes pièces justificatives, notamment de la copie de la décision de non-lieu, de relaxe ou d’acquittement.

Le délai de six mois prévu à l’article 149-2 ne court à compter de la décision de non-lieu, de relaxe ou d’acquittement devenue définitive que si, lors de la notification de cette décision, la personne a été avisée de son droit de demander une réparation ainsi que des dispositions de l’article 149-1,149-2 et 149-3 (premier alinéa).
