Article R261-18 of the French Cinema and Moving Image Code

The Minister responsible for Culture will refer the matter to the Commission for the Protection of Access to Works by sending a detailed confidential report setting out the reasons why the documents and information presented at the time of notification do not enable it to ensure that the beneficiary of the operation is in a position to seek the continued exploitation of the works transferred under conditions equivalent to those resulting from the application of the agreement provided for in article L. 132-27 of the Intellectual Property Code.

A copy of this report is sent without delay to the transferring producer.

Le ministre chargé de la culture saisit la commission de protection de l’accès aux œuvres par la transmission d’un rapport détaillé confidentiel exposant les raisons pour lesquelles les documents et informations présentés lors de la notification ne lui permettent pas de s’assurer que le bénéficiaire de l’opération est en mesure de rechercher l’exploitation suivie des œuvres cédées dans des conditions équivalentes à celles résultant de l’application de l’accord prévu à l’article L. 132-27 du code de la propriété intellectuelle.

Une copie de ce rapport est transmise sans délai au producteur cédant.
