The concession granting authority may not reject a tender on the grounds that it does not comply with the technical and functional specifications if the tenderer proves in its tender, by any appropriate means, that the solutions it proposes comply with these specifications in an equivalent manner.

L’autorité concédante ne peut pas rejeter une offre au motif qu’elle n’est pas conforme aux spécifications techniques et fonctionnelles si le soumissionnaire prouve dans son offre, par tout moyen approprié, que les solutions qu’il propose respectent de manière équivalente ces spécifications.
