I. – In order to combat the spread of disease, the Prefect, acting on a proposal from the Director General of the Regional Health Agency, may prescribe:
1° Measures to place and keep affected persons in isolation, within the meaning of Article 1 of the International Health Regulations, in a health establishment or any other suitable place;
2° Measures to place persons likely to be affected in quarantine, within the meaning of Article 1 of the International Health Regulations, at home or in any other suitable accommodation, in particular those mentioned in Articles D. 3115-18 and D. 3115-19.
II. – The Prefect prescribes the measures mentioned in 1° of I, by a reasoned order issued after consultation with the Director General of the Regional Health Agency when the following conditions are met:
1° The person has been diagnosed as a carrier of a serious contagious disease ;
2° The person has refused, in whole or in part, health care appropriate to their state of health, in particular isolation and treatment, despite repeated requests from health professionals and health services.
III. – The quarantine measures referred to in 2° of I within a military entry point are prescribed by the Prefect, after obtaining the opinion of the manager of the military entry point referred to in article R. 3115-15-1, when they concern a person who has entered the country via a military entry point.
The quarantine measures mentioned in 2° of I are prescribed by the prefect, after informing the Minister of Defence, when they concern a military means of transport or a means of transport specifically chartered by the military authority, stationed at a point of entry that is not covered by article R. 3115-15-1.
