Article R3121-1 of the French Public procurement code

The estimated value of the concession contract is calculated using an objective method, specified in the consultation documents mentioned in article R. 3122-7. It corresponds to the concessionaire’s total turnover excluding taxes for the duration of the contract.
The choice of calculation method used by the conceding authority may not have the effect of exempting the concession contract from the provisions of this book that apply to it, in particular by splitting up the works or services.

Article R3121-1

La valeur estimée du contrat de concession est calculée selon une méthode objective, précisée dans les documents de la consultation mentionnés à l’article R. 3122-7. Elle correspond au chiffre d’affaires total hors taxes du concessionnaire pendant la durée du contrat.
Le choix de la méthode de calcul utilisée par l’autorité concédante ne peut avoir pour effet de soustraire le contrat de concession aux dispositions du présent livre qui lui sont applicables, notamment en scindant les travaux ou services.
