Article R3121-31 of the French Labour Code

The employer may not dismiss for lack of activity, within a period of one month following a period of recuperation, employees normally employed in the establishment or part of the establishment where the recuperation or overtime hours were worked.
This provision does not apply to employees hired temporarily to cope with an extraordinary increase in workload.

L’employeur ne peut licencier pour insuffisance d’activité, dans le délai d’un mois succédant à une période de récupération, les salariés habituellement employés dans l’établissement ou partie d’établissement où ont été accomplies des heures de récupération ou des heures supplémentaires.
Cette disposition ne s’applique pas aux salariés embauchés temporairement pour faire face à un surcroît extraordinaire de travail.
