Article R3121-44 of the French Public Health Code

In the free information, screening and diagnostic centres mentioned in article L. 3121-2 which are not health establishments, by way of derogation, the Director General of the Regional Health Agency may authorise a doctor from the organisation, designated by name, to ensure the supply, holding, control and management of medicines and to dispense them directly to patients. This derogation may only be granted for a replacement not exceeding three months or when the activity does not justify the presence of a full-time pharmacist.

For the purposes of this article, if the Director General of the Regional Health Agency remains silent, authorisation will be deemed to have been granted on expiry of a period of two months from the date of receipt of the application.

The medicinal products are held in a place to which persons not belonging to the organisation do not have free access and are stored under the conditions laid down in the marketing authorisation, under the responsibility of the doctor authorised by the Director General of the Regional Health Agency.

Dans les centres gratuits d’information, de dépistage et de diagnostic mentionnés à l’article L. 3121-2 qui ne sont pas des établissements de santé, à titre dérogatoire, le directeur général de l’agence régionale de santé peut autoriser un médecin de l’organisme, nommément désigné, à assurer l’approvisionnement, la détention, le contrôle et la gestion des médicaments et à les dispenser directement aux malades. Cette dérogation ne peut être accordée que pour un remplacement n’excédant pas trois mois ou lorsque l’activité ne justifie pas la présence d’un pharmacien à temps plein.

Pour l’application du présent article, le silence gardé par le directeur général de l’agence régionale de santé vaut autorisation à l’expiration d’un délai de deux mois à compter de la date de réception de la demande.

Les médicaments sont détenus dans un lieu où n’ont pas librement accès les personnes étrangères à l’organisme et conservés dans les conditions prévues par l’autorisation de mise sur le marché, sous la responsabilité du médecin autorisé par le directeur général de l’agence régionale de santé.
