Article R3122-11 of the French Public procurement code

By way of derogation from article R. 3122-9, when, in duly justified circumstances, for reasons of exceptional security, technical reasons or because of the particularly sensitive nature of commercial information requiring a very high level of protection, the concession-granting authority is unable to provide electronic access to certain consultation documents, it shall indicate, in the concession notice or the invitation to submit a tender, that these documents will be transmitted by means other than electronically.
The deadline for receipt of tenders takes account of this impossibility.

Article R3122-11

Par dérogation à l’article R. 3122-9, lorsque, dans des circonstances dûment justifiées, pour des raisons de sécurité exceptionnelle, des raisons techniques ou en raison du caractère particulièrement sensible d’informations commerciales nécessitant un niveau de protection très élevé, l’autorité concédante est dans l’impossibilité d’offrir un accès dématérialisé à certains documents de la consultation, elle indique, dans l’avis de concession ou l’invitation à présenter une offre, que ces documents seront transmis par des moyens autres qu’électroniques.
Le délai de réception des offres tient compte de cette impossibilité.
