The conceding authority may not require the grouping of economic operators to have a specific legal form when submitting an application or a tender.
However, the conceding authority may require the groupings of economic operators to adopt a specific legal form after the concession contract has been awarded insofar as this is necessary for its proper performance. In this case, the conceding authority specifies the form that will be imposed after award in the consultation documents.

L’autorité concédante ne peut exiger que le groupement d’opérateurs économiques ait une forme juridique déterminée lors de la présentation d’une candidature ou d’une offre.
Toutefois, l’autorité concédante peut exiger que les groupements d’opérateurs économiques adoptent une forme juridique déterminée après l’attribution du contrat de concession dans la mesure où cela est nécessaire à sa bonne exécution. Dans ce cas, l’autorité concédante précise la forme qui sera imposée après attribution dans les documents de la consultation.
