Failure to comply with the provisions relating to night work set out in articles L. 3122-1 to L. 3122-24, L. 3163-1 and L. 3163-2 and the decrees issued for their application is punishable by a fifth-class fine, imposed for each number of employees affected by the offence.
Repeated offences are punishable in accordance with articles 132-11 and 132-15 of the French Penal Code.
Le fait de méconnaître les dispositions relatives au travail de nuit prévues par les articles L. 3122-1 à L. 3122-24, L. 3163-1 et L. 3163-2 ainsi que celles des décrets pris pour leur application, est puni de l’amende prévue pour les contraventions de la cinquième classe, prononcée autant de fois qu’il y a de salariés concernés par l’infraction.
La récidive est réprimée conformément aux articles 132-11 et 132-15 du code pénal.
