Article R3124-8 of the French Labour Code

The following offences are punishable by a fifth-class fine: :

1° By a part-time employee, to work overtime without complying with the limits set by articles L. 3123-9 and L. 3123-28 or by the collective labour agreements provided for by article L. 3123-20 ;

2° By an employee employed under an intermittent employment contract, hours in excess of the minimum annual working time provided for under the contract, without complying, in the absence of the employee’s agreement, with the limit laid down in article L. 3123-35.

Contraventions give rise to as many fines as there are employees unduly employed.

Est puni de l’amende prévue pour les contraventions de la cinquième classe, le fait d’avoir fait accomplir :

1° Par un salarié à temps partiel, des heures complémentaires sans respecter les limites fixées par les articles L. 3123-9 et L. 3123-28 ou par les conventions ou accords collectifs de travail prévus par l’article L. 3123-20 ;

2° Par un salarié employé en application d’un contrat de travail intermittent, des heures au-delà de la durée annuelle minimale prévue par ce contrat, sans respecter, en l’absence de l’accord de ce salarié, la limite fixée à l’article L. 3123-35.

Les contraventions donnent lieu à autant d’amendes qu’il y a de salariés indûment employés.
