The following offences are punishable by a fifth-class fine: :
1° By a part-time employee, to work overtime without complying with the limits set by articles L. 3123-9 and L. 3123-28 or by the collective labour agreements provided for by article L. 3123-20 ;
2° By an employee employed under an intermittent employment contract, hours in excess of the minimum annual working time provided for under the contract, without complying, in the absence of the employee’s agreement, with the limit laid down in article L. 3123-35.
Contraventions give rise to as many fines as there are employees unduly employed.
