Article R313-17-1 of the French Monetary and Financial Code

When the claim is assigned or pledged under a partnership contract or a contract mentioned in the first paragraph of article L. 6148-5 of the Public Health Code, the notification is made to the assigning public accountant designated in the contractual documents. It must include the following information:

1° Under the conditions provided for by Articles L. 313-23 to L. 313-35 of the Monetary and Financial Code, the holder of the partnership contract or of a contract mentioned in the first paragraph of Article L. 6148-5 of the Public Health Code (company name and address of the holder of the partnership contract or of the contract mentioned in the first paragraph of Article L. 6148-5 of the Public Health Code, the assignor) has assigned/pledged to us, in whole/ in part, by docket dated ………….., the receivable relating to the partnership contract or the contract referred to in the first paragraph of Article L. 6148-5 of the Public Health Code signed on ………….. by (name of the contracting public authority) ;

2° The amount of the assigned or pledged receivable is ;

3° In accordance with the provisions of article L. 313-28 of the French Monetary and Financial Code, we ask you to cease, with effect from receipt of this notification, all payments in respect of this claim to (company name and address of the assignor);

4° Consequently, payment of the sums due to the company named above must be made to (name of the transferee institution and method of payment).

Article R313-17-1

Lorsque la créance est cédée ou nantie au titre d’un contrat de partenariat ou d’un contrat mentionné au premier alinéa de l’article L. 6148-5 du code de la santé publique, la notification est faite entre les mains du comptable public assignataire désigné dans les documents contractuels. Elle comporte les mentions obligatoires suivantes :

1° Dans les conditions prévues par les articles L. 313-23 à L. 313-35 du code monétaire et financier, le titulaire du contrat de partenariat ou d’un contrat mentionné au premier alinéa de l’article L. 6148-5 du code de la santé publique (raison sociale et adresse du titulaire du contrat de partenariat ou du contrat mentionné au premier alinéa de l’article L. 6148-5 du code de la santé publique, le cédant) nous a cédé/ a nanti, en totalité/ en partie, par bordereau en date du………….., la créance relative au contrat de partenariat ou au contrat mentionné au premier alinéa de l’article L. 6148-5 du code de la santé publique signé le………….. par (nom de la collectivité publique contractante) ;

2° Le montant de la créance cédée ou nantie est de ;

3° Conformément aux dispositions de l’article L. 313-28 du code monétaire et financier, nous vous demandons de cesser, à compter de la réception de la présente notification, tout paiement au titre de cette créance, à (raison sociale et adresse du cédant) ;

4° En conséquence, le règlement des sommes revenant à l’entreprise désignée ci-dessus devra être effectué à (désignation de l’établissement cessionnaire et du mode de règlement).
