Article R321-34 of the French Intellectual Property Code

The members of the Enforcement Board deliberate on the sanctions in the sole presence of a member of the Control Commission who acts as secretary to the meeting. The secretary draws up minutes of the meeting, which are signed by the chairman of the Enforcement Board and the meeting secretary.

The sanction decision mentions the names of the members who ruled and, where applicable, the procedural costs that are to be borne by the organisation against which the sanction was imposed.

It is notified to the organisation concerned in accordance with the procedures set out in the first paragraph of Article R. 321-32 and communicated to the supervisory board.

Les membres du collège des sanctions délibèrent sur les sanctions en la seule présence d’un agent de la commission de contrôle exerçant les fonctions de secrétaire de séance. Celui-ci établit un compte rendu de la séance, qui est signé par le président du collège des sanctions et le secrétaire de séance.

La décision de sanction mentionne les noms des membres qui ont statué et, le cas échéant, les frais de procédure qui sont à la charge de l’organisme à l’encontre duquel la sanction a été prononcée.

Elle est notifiée à l’organisme concerné selon les modalités prévues au premier alinéa de l’article R. 321-32 et communiquée au collège de contrôle.
