Article R321-40 of the French Intellectual Property Code

The mediator shall promote or encourage any resolution of the disputes referred to him.

The substance of the agreement between the parties, even if partial, recorded by the mediator, shall be recorded in a statement signed by the parties and the mediator specifying the measures to be taken to implement it.

A copy of this statement shall be given to each party by any means capable of establishing proof of the date of receipt.

Le médiateur favorise ou suscite toute résolution des litiges qui lui sont soumis.

La teneur de l’accord entre les parties, même partiel, constaté par le médiateur, est consignée dans un constat signé par les parties et le médiateur précisant les mesures à prendre pour le mettre en œuvre.

Une copie de ce constat est remise à chaque partie par tout moyen propre à établir la preuve de la date de réception.
