Article R321-69 of the French Commercial code

The Conseil des maisons de vente will issue a reasoned decision at the latest within three months of the presentation of the complete file by the interested party.

The decision is notified by any means that confers a date of receipt. The notification shall indicate the time limit and procedures for appealing against the decision.

The Board’s decision may be appealed.
The Council’s decision may be appealed under the conditions laid down in articles R. 321-50 to R. 321-55.

The decision specifies the scope of professional activities open to the applicant.
It also specifies whether the applicant must undergo the aptitude test provided for in II of article L. 321-28-1 and, if so, includes the following information:

1° The level of professional qualification required in France to carry out the activities of voluntary sale of movable property by public auction and the level of professional qualification held by the applicant in accordance with the classification set out in Article 11 of Directive 2005/36/EC of the European Parliament and of the Council of 7 September 2005 as amended on the recognition of professional qualifications;

2° The substantial differences between these two levels of qualification and the reasons why these differences cannot be made up by knowledge acquired through professional experience or lifelong learning which has been duly validated for this purpose by a competent body;

The subject or subjects in which the professional qualification is to be acquired and the reasons why this knowledge cannot be made up by knowledge acquired through professional experience or lifelong learning which has been duly validated for this purpose by a competent body;

The subject or subjects in which the professional qualification is to be obtained
3° The subject or subjects on which the applicant will be tested in the light of his or her initial training and professional experience.

Le Conseil des maisons de vente se prononce par décision motivée au plus tard dans un délai de trois mois à compter de la présentation du dossier complet de l’intéressé.


La décision est notifiée par tout moyen conférant date certaine à sa réception. La notification indique le délai et les modalités du recours ouvert à l’encontre de cette décision.


La décision du conseil peut faire l’objet d’un recours dans les conditions prévues aux articles R. 321-50 à R. 321-55.


La décision précise le champ des activités professionnelles ouvertes au demandeur.


Elle précise également si le demandeur doit subir l’épreuve d’aptitude prévue au II de l’article L. 321-28-1 et comporte, dans l’affirmative, les informations suivantes :


1° Le niveau de qualification professionnelle requis en France pour exercer les activités de vente volontaire de meubles aux enchères publiques et le niveau de la qualification professionnelle que possède le demandeur conformément à la classification figurant à l’article 11 de la directive 2005/36/ CE du Parlement européen et du Conseil du 7 septembre 2005 modifiée relative à la reconnaissance des qualifications professionnelles ;


2° Les différences substantielles existant entre ces deux niveaux de qualification et les raisons pour lesquelles celles-ci ne peuvent être comblées par les connaissances acquises au cours de l’expérience professionnelle ou de l’apprentissage tout au long de la vie ayant fait l’objet, à cette fin, d’une validation en bonne et due forme par un organisme compétent ;


3° La ou les matières sur lesquelles le demandeur sera interrogé compte tenu de sa formation initiale et de son expérience professionnelle.
