Article R3211-10 of the French Public Health Code

The matter is referred to the liberty and custody judge in whose jurisdiction the reception facility is located by means of a request sent to the clerk’s office of the court by any means that enables its receipt to be dated.

The application must be dated and signed and must include :

1° An indication of the surname, first names, profession, place of residence, nationality, date and place of birth of the applicant or, in the case of a legal entity, its legal form, name, registered office and the body legally representing it;

2° An indication of the surname and forenames of the person undergoing psychiatric care, their home address and, if applicable, the address of the establishment where they are staying, as well as, if applicable, the contact details of the person responsible for their legal protection or their legal representatives if they are a minor;

3° A statement of the facts and its purpose.

Le juge des libertés et de la détention dans le ressort duquel se situe l’établissement d’accueil est saisi par requête transmise par tout moyen permettant de dater sa réception au greffe du tribunal judiciaire.

La requête est datée et signée et comporte :

1° L’indication des nom, prénoms, profession, domicile, nationalité, date et lieu de naissance du demandeur ou, s’il s’agit d’une personne morale, celle de sa forme, de sa dénomination, de son siège social et de l’organe qui la représente légalement ;

2° L’indication des nom et prénoms de la personne qui fait l’objet de soins psychiatriques, de son domicile et, le cas échéant, de l’adresse de l’établissement où elle séjourne, ainsi que, s’il y a lieu, des coordonnées de la personne chargée à son égard d’une mesure de protection juridique relative à la personne ou de ses représentants légaux si elle est mineure ;

3° L’exposé des faits et son objet.
