Article R3211-2 of the French Public Health Code

The College provided for in Article L. 3211-9 shall be composed of three members of the staff of the establishment where the patient is admitted.

The formation of each panel is determined by the director or legal representative of the institution. The following are members of the college for each patient

1° The psychiatrist primarily responsible for the patient whose situation is being examined or, failing this, another psychiatrist involved in the patient’s care;

2° A representative of the multidisciplinary team involved in the patient’s care, appointed by the director of the establishment;

3° A psychiatrist who is not involved in the patient’s care, designated by name by the director of the establishment, after consulting the chairman of the establishment’s medical commission or the medical conference for doctors.

The director or the legal representative of the institution shall include the names of the three members in the notice convening the meeting.

Le collège prévu à l’article L. 3211-9 est composé de trois membres appartenant au personnel de l’établissement d’accueil du patient.

Chaque formation du collège est fixée par le directeur ou le représentant légal de l’établissement. Font partie du collège pour chaque patient :

1° Le psychiatre responsable à titre principal du patient dont la situation est examinée ou, à défaut, un autre psychiatre participant à sa prise en charge ;

2° Un représentant de l’équipe pluridisciplinaire participant à la prise en charge du patient, nommément désigné par le directeur de l’établissement ;

3° Un psychiatre qui ne participe pas à la prise en charge du patient, désigné nommément par le directeur de l’établissement, après avis du président de la commission médicale d’établissement ou de la conférence médicale pour les médecins.

Le directeur ou le représentant légal de l’établissement inscrit le nom des trois membres dans la convocation.
